Acceptance of terms
These Terms of Service ("Terms") govern access to brandgrowagency.com and services provided by BrandGrowAgency Media Pvt. Ltd.. By creating an account or using our services, you agree to these Terms.
Our services
BrandGrowAgency provides influencer marketing agency services, a creator marketplace, campaign management tools, and related content production services for brands and creators in India and select international markets.
Specific deliverables, timelines, and fees are defined in campaign proposals, statements of work, or platform subscription plans agreed separately.
Accounts & eligibility
You agree to:
- Provide accurate registration information and keep it updated.
- Maintain confidentiality of login credentials.
- Use the platform only for lawful business purposes.
- Creators must be 18+ or have guardian consent where applicable.
Campaigns & content
Brands and creators are responsible for content compliance with applicable advertising standards (including ASCI guidelines in India), platform policies, and disclosure requirements (#ad, paid partnership labels).
Usage rights, exclusivity, whitelisting, and revision rounds are defined in campaign contracts. Unless otherwise agreed, brands may not use creator content beyond licensed scope.
Fees & payments
Agency fees, creator rates, and platform subscription charges are quoted in INR unless stated otherwise. Taxes (GST) apply as per Indian law.
Creator payouts are processed per campaign contract terms. BrandGrowAgency may withhold payments pending content approval or dispute resolution.
Intellectual property
Our website, platform, tools, branding, and proprietary matching technology remain our intellectual property.
Campaign content ownership and license terms are specified per deal. Default licenses do not transfer unless explicitly stated in writing.
Limitation of liability
Services are provided on an "as is" basis to the extent permitted by law. We are not liable for indirect, incidental, or consequential damages arising from platform use or third-party platform changes (Instagram, YouTube, etc.).
Our aggregate liability for any claim is limited to fees paid to us for the specific campaign or subscription period giving rise to the claim.
Termination
We may suspend or terminate accounts for breach of these Terms, fraud, or harm to other users. You may close your account by contacting support; outstanding campaign obligations survive termination.
Governing law
These Terms are governed by the laws of India. Courts in Mumbai, Maharashtra shall have exclusive jurisdiction, subject to mandatory consumer protection provisions.
